Texas Lemon Laws
To qualify under Texas Lemon Law, you must have a vehicle that has faced multiple repair attempts under warranty. If we can show that the vehicle is indeed a lemon, the manufacturer must replace the vehicle or refund it.
Now Texans do have to jump through a few hoops. First we have to give a manufacturer 'reasonable opportunity' to repair the defects. This is a vague standard but there are plenty of tests we can apply to determine if the dealer / manufacturer gave you a reasonable opportunity.
If you've taken the car in for repairs 4 times within the first two years or 24,000 miles, and are still having issues, there's a good chance you have a case. If the issue is a safety hazard, you may have a case if you've only brought the car in twice to get it fixed. Additionally if your vehicle has been out of commission for 30 days or more within this window and the dealer has not given you a comparable loaner, you are on solid grounds to recover damages.
In Texas, Lemon Law is administered by TDOTs Motor Vehicle Division and Motor Vehicle Board. There are options to go before administrative hearings as well as pursue action in court, and often dealers will just settle for sizable sums of money rather than go through the hassle.

Warranty Law: If a dealer sold you a defective car, there may be a chance to pursue legal action under federal warranty laws. The most common one is the Magnuson-Moss Warranty Act, which requires dealers and manufacturers to give detailed information about warranties.
Texas Uniform Commercial Code: Another option consumers can leverage is the Texas Uniform Commercial Code (UCC). One benefit of this code is that it has a 4 year statute of limitations, which is longer than the 2 years of the Texas Lemon Laws. This law essentially gives you rights to return a defective vehicle, assuming that the defects are proven and can substantially reduce the car's resale value.
